Acceptance of these terms and conditions

The present conditions apply to the sale of products by Château Constellation SA on its Internet store. They are made available to the buyer on the home page of the Château Constellation website. For an Internet user, confirming an order on the Château Constellation SA website (by clicking on the “validate” button) implies full acceptance of these general terms and conditions of sale (GTCS) in their entirety.

General

By placing an order, the customer confirms that he/she has read and accepts the present conditions. Bebogen and the various brands distributed by BEBO Health SA (such as SLIM SONIC, Maiday, Snø) reserve the right to modify these conditions without prior notice; the conditions in force at the time of the order are valid.

Products Availability

The products may differ slightly from the illustrations on the presentation materials, which are presented for information purposes only. Every effort is made to display items that are accurately mentioned as being in stock. The availability of the product is stated on each product description.
In the event a product is unavailable after an order has been placed although initially mentioned as being in stock, the Customer will be informed as soon as possible by e-mail.

Data Protection

By the provisions of the Federal Law on the Protection of Trademarks and Indications of Source (RS 232.11) of August 28, 1992, concerning the legal protection of databases, Bebogen through Arpege SA is the producer and owner of all or part of the databases making up this site. All data on this site (text, images, graphics, logos, icons, etc.) is protected by copyright. Arpege SA reserves the right to modify the contractual terms and conditions of use without prior notice by updating this publication. These changes from the date of said changes bind users.

Use of personal information

Your personal information will never be passed on to third parties, except in exceptional cases where we are obliged to do so by law. We do not collect any personal data about you without explicitly stating so (e.g. registration process). The information collected is used for statistical purposes only. You can modify your personal information in your profile at any time. No unsolicited commercial e-mail will be sent to you by http://ch.bebogen.com.

Sale and payment

Unless otherwise arranged, all orders will be delivered only after we receive the total amount. We reserve the right to refuse an arrangement without explanation. Orders are final; no refunds will be made once money is paid. The prices are indicated without VAT and delivery.

The prices in CHF or € indicated on the current price list are binding, the amounts displayed in other currencies are indicative. When making a payment, please do so in CHF or €. All bank charges are to be paid by the customer, who must specify this to the intermediary when making a payment. Thus the bank will make the appropriate conversions so that there is no error on arrival on our account, which would delay the delivery by the need for a complement.

For orders made outside of Switzerland, the buyer proceeds to an import (VAT, customs fees, processing, etc. …). These taxes are charged directly by the customs authority of his country and are therefore not included in the prices displayed on our price lists. It is up to the buyer to find out beforehand about the import conditions of the destination country to avoid unpleasant surprises. The goods are declared at their real value.

Delivery

Orders are released within 3 working days (and 15 days for made-to-order products) of receipt of payment. Please be aware that the products are stored in a semi-finished form due to the choice of colors.

The manufacturing lead time for our made-to-order products is 8 working days. Every effort is made to ensure prompt delivery, but delays beyond our control cannot be ruled out. No damage can be claimed in case of late delivery, and the order cannot be cancelled.

Delivery is free in France and Switzerland from 99 CHF.

For orders placed outside of Switzerland, the buyer is responsible for paying customs duties and solving any import problems.

We decline any responsibility in case of litigation with the carriers.

Retraction period

The withdrawal period is 14 days from the date of reception of the goods.

Our Slim Sonic Modules are equipped with internal counters to determine the total time of use. If we find that your device has been used for more than 120 minutes (i.e., three complete sessions), we reserve the right to make a partial refund or to refuse any refund, depending on the condition of the returned device.

Please note that second-hand models presented under “Outlet” are not covered by the right of withdrawal as they are not new appliances.

After-sales service, Warranty

We directly provide the entire after-sales service of our products; please contact us, if necessary, directly from the page explaining our after-sale services. Bebogen organizes shipping addresses for Switzerland and Europe ([email protected]).

We offer a two-year warranty on all our new products. Products reconditioned as new are guaranteed for 18 months, and little-used reconditioned products, consumables, straps, and elastics are guaranteed for 12 months. The warranty only covers product defects. Any damage caused by misuse and any modification or attempted repair by the customer without prior authorization will void the warranty.

We offer a repair service for some products outside the warranty coverage. This service is not free of charge, an estimate is made by us once the material is returned. The repair is carried out after full payment of the amount of the estimate.

All material returns require prior authorization from us. Material received without arrangement will not be processed. Shipping costs are at the sender’s expense, as well as any customs fees that may be charged to us upon receipt.

Consumer guarantees

The customer guarantees that merchandise is manufactured, checked and packaged without any physical defects.
This guarantee does not cover defects that the buyer may discover upon examination of said merchandise.
If product defects are revealed after delivery, the Buyer shall request application of the product guarantee in writing. This request shall include the invoice number and the reason for requesting replacement of the product(s) in question.
The products sold on ch.bebogen.com comply with current regulations in Switzerland and Europe. Arpege SA liability shall not be engaged in case of non-observance of the legislation of the country in which the products are delivered, which the Customer is to verify.

Payment

Payment for goods must be made in full when the order is placed, either by credit card (secure online payment) such as Visa, MasterCard or PostFinance. In case the buyer does not pay for merchandise within the payment period, the vendor has the right to cancel the sales contract, request the return of said merchandise and to demand payment of punitive damages to cover the loss of revenue and other additional costs incurred because of non-payment.

Credit card transaction security

A secure 128-bit SSL connection protects the credit card payment module in our e-shop. Thus, your data transmitted through our shop is protected. This protection complies with the legal provisions currently in force in Switzerland. You can, therefore, make your purchases with complete security and confidence.

Right of withdrawal

In all cases, the customer must inform the sales department in writing (telephone, e-mail, fax, letter) of his decision before returning the goods. By way of exception, these provisions do not apply to orders for products that have been customized or specifically requested by the customer at the time of ordering (special formats, customized packaging, etc.).

Disclaimer of warranties and limitation of liability

ch.bebogen.com is provided by the vendor on an “As is” and “As available” basis. Bebogen will not be liable for any damages of any kind arising from the use of this site, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

Site policies, modification, and severability

Bebogen reserves the right to change our site, policies, and these Conditions of sale at any time. If any of these conditions is deemed invalid, void, or unenforceable for any reason, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Applicable law and jurisdiction

These GTCs are subject to Swiss law. The courts of the Canton of Fribourg shall have exclusive jurisdiction over any dispute relating to sales concluded under these terms and conditions, subject to possible appeal to the Federal Court.
